County statement on motions in Adams vs. Cobb Board of Elections
August 6—Cobb County has filed two motions regarding a Superior Court Judge’s recent rulings in a case involving the county’s commission district maps.
The rulings in Adams vs. Cobb Co. Board of Elections and Registration adopted the constitutional analysis of the Floam Summary Judgment Order (which was overturned by the Georgia Supreme Court) as to the county’s use of its “home rule” maps. The judge also ordered new primary and general elections in two commissioner districts.
While the county agreed it would return to the state legislative map in a lawful and orderly manner, the motions were filed to ensure proper legal procedures were followed and to protect the interests of Cobb County taxpayers.
The county was not a party in the Adams case.
The Motion to Intervene and Motion to Reconsider ask Judge Kellie Hill to allow the county attorney’s office to present arguments on the county's significant interest in these cases and why it is improper to order new elections in Districts 2 and 4 after voters have already cast ballots in a primary.
While it is not intended to delay a resolution in this vital matter, it is essential for everyone that this matter follows the correct legal path and provides as little disruption to county residents as possible.
