DUI Court

Cobb County DUI court is a voluntary, post-conviction, treatment-based program for those who have been convicted multiple times for driving while under the influence of alcohol or other intoxicants. The DUI Court offers enhanced supervision, counseling, and treatment to help participants function in the community with continuing support.

The mission of the Cobb County DUI Court is to enhance public safety by targeting repeat DUI offenders for placement in an intensive program of treatment, judicial supervision, and individual accountability. The goal of the program is to reduce participant recidivism and enable participants to contribute to and function within the community.

The Cobb DUI Court program is always evolving and adapting the program to meet national and state standards and best practices.  The Cobb County DUI court is a fully certified Georgia accountability court.

 

 

Eligibility

  • Second DUI in ten years or third in lifetime
  • Cobb County resident
  • 17 years of age or older
  • Indication of alcohol/drug abuse or dependence
  • No violent felony offenses
  • No out-of-state warrants
  • Valid/current residence/immigration status

 

 

Program Entry

Referrals to DUI Court must be approved by the assigned judge and the assigned prosecutor. After the defendant and his or her attorney complete the application packet, a preliminary assessment will be administered. The DUI Court Team will then make the final decision regarding program entry.

Phases of the Program

Each participant’s progress will be reported to the entire DUI Court team through weekly staff meetings held prior to the status conference court proceeding.

Detailed status reports are prepared and copied for the Judge and all team members to review as a part of the staffing process.

A review of their treatment and overall program status will be discussed, along with any program violations and recommendations.

The judge finalizes all rewards and sanctioning.

The program takes a minimum of twelve months to complete.  Progress is contingent upon the participants' individual compliance and completion of program requirements.
